JOINT ACTION COMMITTEE OF ACCOUNTS AND AUDIT EMPLOYEES AND OFFICERS ORGANIZATIONS



JAC Dharna on 26-03-2014 – Participate And Make it Grand Success

Dear Comrades,

The Apex JAC has taken a decision to revitalize and reactivate the JAC of Accounts employees and officers organizations through out the country to not only to achieve our long pending demands but also to have a vibrant platform to articulate the voice of Accounts and Audit employees. Countrywide lunch hour demonstrations were held on 19th /20th December 2013 by all JAC constituents. A joint meeting of all the constituents of JAC was held at New Delhi on 11-01-2014 and chalked out a phased programme of action. Accordingly massive daylong dharnas were successfully held at all centers before Accounts and Audit offices on 29-01-2014 and passed resolutions.

In spite of assurances to hold discussions on the issue of pay scales of Audit and Accounts employees no serious steps were taken in that direction by the DOP&T. This inaction on the part of Government should provoke all of us to unite and fight more determining way to achieve our charter of demands. Audit and Accounts Employees and Officers have a great legacy of struggle. Because of our continuous and persistent struggles only we could achieve parity demand. We are demanding restructuring of Audit and Accounts Cadres with higher pay scales, payment of arrears of upgraded pay scales from 01-01-1996 to 18-02-2003, implementation of Arbitration Awards etc. To goad the Government to take a positive decision on these demands, there is no short-cut method except struggle. The need of the hour is to unite under the banner of JAC of Accounts and Audit employees and make it stronger and vibrant.
The apex JAC has given a call to all the Accounts and Audit employees and officers to conduct joint dharnas at a centralized place and pass resolutions demanding the settlement of the issues being raised by the Accounts and Audit employees. Organize day long dharna at all centers throughout the country and send Resolutions.

Demands
1.      Payment of arrears of Pay from 1st Jan 1996 to 18th Feb 2003 as directed by Courts to Audit & Accounts cadres.
2.      i) Upgradation of LDC as Audit/Accounts Assistant and merger of Auditor/Accountant and SA
ii) Granting following pay scales to Audit & Accounts Cadres
                                                Audit/Accounts Asstt - GP 2400. PB 1
                                                SA                                 - GP 4600, PB2
                                                AAO                                - GP 5400, PB2
                                                AO                                 - GP 6600, PB3
                                                SAO                                 - GP 7600, PB4
iii) Granting MACP on departmental hierarchy basis
iv) Granting one increment and Grade pay of Rs: - 5400 from the day of passing AAO/SOG examination
  v) Granting three increments on passing departmental confirmatory examination.

THERE IS SO MUCH CONFUSION GENERATED WHILE IMPLEMENTING THE STEPPING UP OF PAY AS DIRECTED BY THE HON’BLE COURT. THE VIEW POINT OF AIPAEA ON THE COMMON DOUBTS EXPRESSED IS GIVEN UNDER

Applicability of the Tribunal judgment
Whether the judgment is applicable to the directly recruited LDCs or to the promotees from Group D cadre.?
Stepping up of the pay is to be done by comparing the pay of Senior Sr.Accountant with that of Junior Sr.Accountant(ACP SA) in the same cadre. Entry grade of Senior Sr.Accountant is not relevant.

Pay
Whether grade pay is to be taken for the purpose of stepping up?
The judgment in Ashok Kumar Vs.UOI, was based on the ACP scheme introduced w.e.f. 9-8-1999 where pre-revised scales existed.  As such, the pay drawn in a pay scale means basic pay only.  With the introduction of revised pay scales w.e.f. 1-1-2006, basic pay means the pay drawn in the prescribed pay band plus the applicable grade pay.  Hence stepping up w.e.f 1-1-2006 is to be done by comparing pay and grade pay of a Senior Sr.Accountant  with that of junior Sr.Accountant.

Parity on account of MACP
Whether parity is to be maintained consequent on grant of MACP?
MACP scheme was introduced with effect   from  1-9-08 modifying and  replacing the existing ACP scheme on the recommendations of 6th CPC.  In the MACP scheme, 3rd financial upgradation is allowed in addition to the earlier 2 financial upgradations under ACP scheme.  This again results in junior SA drawing more basic pay than that of Sr.SA.  The Hon’ble Tribunal directed           the pay parity would be compared annually and parity would be maintained in future…” Hence it is imperative to settle the subsequent anomalies that may arise in future due to financial upgradations.

Parity with Junior transferred under Rule 38
Whether stepping up can be done with Junior transferred under rule 38?
Para 9 of judgment in OA 156 of 2009(Ashok Kumar Vs.UOI)speaks about stepping up of the pay of a senior SA at par with his junior who has been granted benefit under ACP scheme and by virtue of this, is receiving higher pay than his senior.  Transfer under rule 38 is not a relevant factor to decide stepping up of pay.
The Sr.SA all along draws equal or more pay than that of the Junior SA who was transferred under rule 38 and consequent on grant of ACP, the junior gets more pay, then the pay of senior SA should be stepped up.
