AIPAEA LETTER ON NON-IMPLEMENTATION OF STEPPING UP JUDGMENT

Sub:- Non-implementation of judgment of Hon’ble Central Administrative
          Tribunal, Principal Bench in O.A. No. 2124/2011 upheld by Hon’ble
          High Court, Delhi by PAOs – Regarding.

Sir,
I am hereunder submitting the details of the cases pending implementation of the judgment of the Hon’ble CAT, Principal Bench, New Delhi in the O.A. No. 2124/2011.

Out of 20 Postal Accounts Circles 16 Postal Accounts Offices are having the Senior Accountants eligible for stepping up of their pay as enunciated by the Hon’ble Tribunal.

The PAOs Ambala, Ahmedabad, are having only three cases each and were settled. The PAO Sundernagar is having the cases of four Senior Accountants, who joined the Department as Gr.D/Sorter.

Excluding the above stated three small Circles, in the remaining 13 Postal Accounts Offices only 3 PAOs i.e. Chennai, Jaipur and Trivandrum have made payment to all eligible officials (excluding the Gr. D /Sorter entry grade Senior Accountants). In all other PAOs i.e. 9 PAOs (Information from Delhi unit awaited) the Judgment has not been implemented in respect of many eligible officials. Only partial implementation has taken place.


In spite of the clear-cut clarifications issued by the PA Wing the PAOs are reluctant to make payment on one pretext or the other. The PA Wing vide its Lr. no. 33(3)/10/PA-Admn.I/104-129 dated 9-4-14 reiterated its earlier clarification (Point 1) that the pay of all Sr. Acctts should be stepped up who had entered the Department as LDCs and subsequently promoted as JA/SA should be considered on par with Sr. Acctts who are junior to the former in the SA cadre. This basic clarification has not been followed by the PAOs. Instead they are comparing the pay in the lower cadre i.e. JA cadre ignoring the position in the S.A. cadre. This Association has been requesting to step up the pay of the senior most S.A. with that of the junior in the SA Cadre on account of junior S.A. drawing more pay due to promotion under ACP/MACP. Another reason for non-compliance is the subjective interpretation of “applicant” by the PAOs like Lucknow, Bhopal.

I am herewith furnishing the annexures containing the list of not settled cases submitted to CHQ by the Circle Associations of AIPAEA for your perusal.

I request you to kindly cause necessary favourable action in this regard.

STEPPING UP CASE
As you all are  aware that the hearing on our Contempt Petition in the Hon’ble Principal CAT is on 03-12-2014. Hon’ble Tribunal has directed AIPAEA to file an affidavit on the status of Payments made by the Circles. Hence, it is absolutely essential that all the Units should report to the CHQ by email (aipaea2009@gmail.com) the following details. Please send the hard copy also by Post to CHQ address. All units should email the following details. No deviations please and No SMS. 
1.    Number of beneficiaries eligible for the stepping up of Pay including retirees.
2.     Payment made by the office (give the number of Officials).
3.     List of officials whose cases not settled by the office till date (excluding the Gr.D/Sorter entry grade) Give Names including retirees and newly joined members.
4.    Reasons for non-settlement.
5.    Details of reminders issued by the Circle Association in this regard.
6. Name of the DA(P)/GM &Circle.
7.    List of eligible officials along with names whose entry grade is Gr.D /Sorter.
It is requested to immediately address letters to the DA(P)s. Meanwhile another D.O. letter to the Directors is under issue by the PA Wing. This time we will name all the DA (P)s in the Affidavit who have not made payments.

The Miscellaneous Application in respect of Sorter/Gr.D entry grade filed by us has  been listed for hearing on 03-12-2014.

Government and Postal board are totally negative and insensitive towards the demands of five lakhs Postal and RMS employees including Gramin Dak Sewaks and Casual, Part-Time Contingent employees.

Dear Friends and Comrades,

Meeting of the Postal Joint Council of Action was held on 11.11.2014 at New Delhi. Shri D. Theagarajan, Secretary General, FNPO presided. Com. R. N. Parashar, Secretary General, NFPE presented agenda items for discussion. General Secretaries of affiliated Unions/Associations of NFPE & FNPO attended. Com. M. Krishnan, Ex-Secretary General of NFPE was also present in the meeting. PJCA reviewed the progress in settlement of 39 points charter of demands submitted to Secretary, Department of Posts on 28.08.2014. PJCA came to the unanimous conclusion that not even a single issue is settled by the Government and Department. Employees are suffering but authorities are turning a deaf year towards their genuine demands. Rome is burning but Neros are fiddling.

None of our demand is unjustified. Five lakhs Postal and RMS employees including Gramin Dak Sewaks and Casual, Part-time, contingent employees cannot remain as mute spectators. There is a limit for our patience. Government and Postal Board are treating our patience as our weakness.

Taking into consideration all the above aspects, the PJCA unanimously took the following decision.
1.      Entire five lakhs employees of the Department of Posts will go on indefinite strike from the third week of February 2015, if the demands are not settled before 31.12.2014.
2.      The date of the indefinite strike will be declared in the 4th December 2014 Parliament March.
3.      Every effort should be made by all All India/Circle/Divisional Unions to ensure maximum participation of employees in the Parliament March. Minimum 20000 employees should participate in the March. All should bring flags and banners.
4.      Laaders of INTUC, CITU, AITUC & JCM National Council staff side will be invited to address the Parliament March.
5.      Next PJCA meeting will be held on 03.12.2014 at 5 PM to decide the date of indefinite strike.

Let us march ahead with Determination and courage. This is time to show your sincerity towards the cause of five lakhs employees of the Department of Posts. Let us make the parliament March a Historic success. Let us unite together and make the indefinite strike a Thundering success. Let the Government and Postal Board understand that we are not Dumb-Driven cattle. We are workers and not beggars.
