FIXED MEDICAL ALLOWANCE FOR NON-CGHS PENSIONERS ENHANCED WITH EFFECT FROM 1.9.2008 BY THE GOVERNMENT

Dear Comrades - The Department of Pension and Pensioners' Welfare has enahnced the quantum of Fixed Medical Allowance granted to Central Government Pensioners who are residing outside the CGHS area from Rs.100/- to Rs.300/- with effect from 1.9.2008.

Confederation and Staff side have demanded the enhancement to at least to Rs.600/- or Rs.500/- - But the Government has enhanced it to only Rs.300/- which is far short of our demand.

RTI ACT - DOPT ORDERS ON PAYMENT OF FEE

PAYMENT OF FEE UNDER THE RTI ACT

DOPT clarifies that if any additional fee is charged for providing the information sought for except prescribed under the Rules 6(1); 7(1); and 7(5), then the same would be construed as contravention of the RTI Act. It is also clarified that the meaning of "Further Fee" prescribed under Rule 7(3) is only the procedure to avail the "Further Fee" mentioned under Rule 7(5) and not anything additional. It is also reieterated that since under the RTI Act there is no provision to charge towards Postal expenses or towards the cost of man power involved in supplying the information sought, such cost cannot be claimed from applicants. However if the information sought for in a particular 'form' that would disproportionately divert the resources of the public authority, then those are already covered under Rule 7(9) of the Act which says that supply of information in a 'particular form' may be refused if supply of information in that form would divert the resources of the public authority disproportionately.

FIRST MEETING OF THE JOINT COMMITTEE CONSTITUTED BY THE

NATIONAL ANOMALY COMIITEE ON 25/05/2010



Dear Comrades - Though there are more than 30 items of anomalies submitted by the Staff Side to the consideration of the Joint Committee set up by the National Anomaly Committee to go into the MACP related anomalies, only around 8 items could be discussed in the first meeting held on 25.05.2010. Comrades Umraomal Purohit; Juman Singh; S.K.Vyas and C.Sreekumar [Staff Side Members ] attended the meeting chaired by the Joint Secretary Establishment DOPT.

The Circular released by the Secretary General Confederation communicating the issues discussed in the meeting and the results thereof is placed in the website of Confederation as well as placed hereunder for your information. The issue of "Discounting the examination based promotions while granting MACP to protect the Promotees against deprivation of any MACP to them" was not discussed in the meeting yesterday. NFPE has discussed the issue with the President Confederation Comrade S.K.Vyas and he has assured that this item would be raised in the next meeting of the Joint Committee that may take place very soon.

Dear Comrades,

A joint Committee on MACP met today under the chairmanship of Joint Secretary Establishment of DOPT. Following issues were discussed:

1. Item No:1:Provide Grade Pay of the next promotional post under MACP.
Staff Side pressed for placement in the Grade Pay of the Promotional Post instead of next higher Grade Pay in the hierarchy of revised Pay Band and Grade Pay. It was insisted because the career progression only means the promotion in the hierarchy and not to a Grade Pay which is not present in the hierarchy of the respective department.
The Staff Side also gave an alternative that first two MACPs after 10 and 20 years should be to the next promotional post as per the hierarchy of respective department as under the erstwhile ACP scheme and thereafter the third MACP in the next Grade Pay of the Revised Pay Band and Grade Pay.

2. Item No:2:Date of Effect.
It was demanded that MACP scheme may be introduced with effect from 1.1.2006. A scheme which has been recommended by the 6th CPC will be not available to those employees who have opted for revised pay scales w.e.f. 1.1.2006 but had retired or died before 1.9.2008, which is very anomalous.

3. Item No:3:Option for earlier ACP Scheme.
Staff Side pointed out that the benefit which employees were getting through two ACPs after 12 and 24 years of service is much higher than the benefit that they will get under MACP after three financial upgradations. It was therefore urged that the service conditions which were available to the existing employees cannot be adversely revised and if that happens then an option to retain the old scheme is inherent. And if the present MACP is not converted to hierarchical pattern, then at least an option may be given to retain the erstwhile scheme of ACP.

4. Item No:7:Grant of financial upgradation between 1.1.2006 and 31.8.2008.

In Para 9 of the DOPT OM dated 19.5.2009, it had been provided that earlier ACP scheme will continue to operate for the period from 1.1.2006 to 31.8.2008. However, this is not being allowed to officials who have opted for revised Pay Band and Grade Pay with effect from 1.1.2006. In some offices, it is being insisted that financial upgradation under the earlier ACP would be granted only in the pre-revised pay scales and they will have to opt for the revised pay scales only from the date they are granted the financial upgradation under earlier ACP. It was demanded that earlier ACP benefit may be given also to those officials who have come over to the Revised Pay Band and Grade Pay with effect from 1.1.2006.

5. Item No:8:Anomaly on introduction of MACP Scheme.

By an illustration in respect of Junior Engineer of CPWD, it has been pointed out that under earlier ACP they will go up to the revised Pay Band 3 with Grade Pay of 6600/- on completion of 24 years of service, whereas under the MACP Scheme, even after 30 years of service and getting third MACP they will get the Grade Pay of 5400/- only in PB-2. This is obviously less advantageous and therefore the demand for option to retain the old ACP scheme has been insisted.

The Official Side indicated that they will consider all these demands and in the next meeting they will indicate how far they can go.

6. Item No:4: Applicability of MACP Scheme to Group D employees who have been placed in the Grade Pay of 1800/-.

The DOPT had already stated that all promotions and upgradations granted under ACP Scheme of 1999 in the post of four pay scales S-1, S-2, S-3 and S-4 shall be ignored for the purpose of MACP. In other words all the three MACP will be available to all the Group D employees who have since been placed in the grade pay of 1800/-. If an employee has completed 10 years of service he should be granted the GP of 1900/-; if completed 20 years of service he should be granted the GP of 2000/-; and if he has completed 30 years of service he should be placed in the GP of 2400/-. In some departments these MACP has not been granted to the Group D employees. The staff side therefore insisted an enabling clarificatory instructions may be issued. The Official Side agreed to issue such clarificatory instructions.

7. Item No:5: Counting 50% of service rendered by Temporary Status CLs for reckoning 10,20, and 30 years of service under MACP scheme.

It was pointed out that the Railways have already issued orders for counting 50% of service rendered by Temporary Status Casual labourers for reckoning 12 and 24 years of service under the old ACP scheme. It was also pointed out that Courts have also ordered that total service rendered as TS CLs may be counted for the purpose of ACP. The Official Side were of the opinion that 50% of service rendered by TS CLs has been counted only for the purpose of pension. The Staff Side pointed out that the TS CLs have been granted all the facilities admissible to a Temporary Employee in respect of leave, increment, pay scale etc and therefore this may be deemed as a regular service for the purpose of MACP also as has been done by the Railways. The Official Side wanted the order of the Railway Department regarding ACP and the Orders of the Courts for their examination.

8. Item No:6: Supervised staff placed in higher Grade Pay than that of the supervisor.

The Staff Side suggested that this item may be transferred to National Anomaly Committee item and discussed there. This has been agreed to.

There are 23 more items which have been suggested by the Staff Side leaders of Railways. It was pointed out that leaders of other departments may also suggest many other anomalies related to MACP. The Staff Side stated that as and when these additional items are received they may be included in the Agenda for discussion in the subsequent meetings. The Official Side agreed to.


NOTE: All Affiliated Unions / Associations of the Confederation may send items of anomalies of MACP to the headquarters at the earliest for enabling inclusion in the next meeting. The Official Side indicated that the next meeting of the Joint Committee will be held very soon.

     DoP Orders Corrigendum for grant of MACP on completion of 10 years of service from Second Promotion or 30 years of total Service whichever is earlier

     Department of Posts has issued a Corrigendum Order on 20th May 2010 for grant of 3rd MACP on completion of 30 years of total service or 10 years of service from the date of 2nd Promotion,
whichever is EARLIER.

After this Corrigendum the earlier confusion prevailed in some areas about 'Whichever is LATER' is now removed.

POSTAL JCA OF NFPE AND FNPO AND GDS UNIONS UNANIMOUSLY DECIDED FOR LAUNCHING A SERIES OF PROGRAMMES INCLUDING NON-COOPERATION CULMINATING IN AN INDEFINITE STRIKE OF POSTAL EMPLOYEES

NFPE - FNPO - GDS Unions came together under the banner of Postal Joint Council of Action once again

     Considering the mounting attacks on the Postal Services and Staff and the total unilateralism on the part of the Department of Posta on all major issues as well as non-settlement of several major issues of Postal Employees, the Postal JCA came to the conclusion that there is no alternative before the Postal Trade Union Movement than organise a sustained movement of Postal Workers

     Indefinite Strike would commence from 13th July 2010 followed by a nationwide Non-cooperation Movement - The Programme of Action containing several stages will commence from 1st June 2010 when the Strike Notice would be served on the Department at Directorate as well as at all levels of Postal Administration.

This writ petition is directed against the order dated 30.06.2005(Annexure-13), passed by the Central Administrative Tribunal, Patna Bench, in O.A no. 925 of 2003 (Sudama Singh & Ors versus The Union of India & Ors), whereby the original application preferred by the present petitioners have been rejected, and the decision of the respondent authorities granting higher pay-scales to the category of the employees of the petitioners on notional basis, has been upheld.

2. A brief statement of facts essential for the disposal of the writ petition may be indicated. The recommendations of the Vth Pay Commission constituted by the Union of India were enforced w.e.f. 1.1.1996. The Indian Railways adopted the report of the Pay Commission by framing the Railway Services (Revised Pay Rules), 1997, in terms of Article 309 of the Constitution of India marked Annexure-1. After the recommendations of the Vth Pay Commission were enforced, anomalies were pointed out with respect to the recommendations so implemented. The Indian Railways considered the same, and issued orders rectifying the anomalies. In so far as the grant of appropriate pay-scales to the category of Accounts Establishment is concerned, to which the petitioners belong, the Ministry of Railways issued notification dated 7.3.2003 (Annexure-3), giving appropriate pay-scales to

the employees of this category. The supplementary notification dated 16.6.2004 (Annexure-9), deals with the post-retirement benefits admissible to this category of employees. The petitioners complain about the following clause of Annexure-3, whereby notional benefits were given to the petitioners: “ The above revised pay scales have been granted on notional basis with effect from 01.01.96 and actual payment prospectively from the date of approval of Cabinet i.e. 19.02.2003.” The same was challenged by preferring the original application before the Tribunal, praying therein that they should have been given the actual money benefits w.e.f. 1.1.1996, the date on which the recommendations of the Vth Pay Commission were enforced, rather than giving the benefit notionally. The original applicants also raised the issue of discriminatory treatment. The same has been rejected by the impugned order, inter alia, on the ground that the petitioners have not been given discriminatory treatment.

3. We have perused the materials on record, and considered the submissions of learned counsel for the parties. The petitioners are obviously aggrieved by the aforesaid notification dated 7.3.2003 (Annexure-3), and the consequential notification dated 16.6.2004 (Annexure-9), dealing with post-retirement benefits, whereby the benefit of higher pay-scale has not been given effect retrospectively, but on notional basis. As stated hereinabove, the Annexures- 3 and 9 applied to the employees of the Accounts Establishment of the Indian Railways,

and the petitioners belong to this category of employees. 4. Before we proceed further, we must notice the three other notifications issued by the Eastern Railway which is relevant in the present context, and is summarized herewith for the facility of quick reference:

(i) The notification dated 8.12.1998 (Annexure-4), with respect to pay-scale of Artisan staff in Railways , whereby higher pay-scales were granted after the anomalies in the recommendation of the Vth Pay Commission were detected, whereby revised pay-scales were granted with effect from 1.1.1996. The relevant clause is reproduced hereinbelow for the facility of quick reference

“INDEX NO. 1057: Revised pay Scales of Artisan Staff in the Railways consequent upon – Vth Central Pay Commission.”

(ii) The notification dated 26.11.1999 (Annexure-5), with respect to pay-scale of Master Cook in Catering, Medical and Canteen Departments, whereby revised pay-scales were granted with effect from 1.1.1996. The relevant clause is reproduced hereinbelow for the facility of quick reference.

“INDEX NO. 1057. Revised Pay Scale allotted to Hd. Cook and Master Cook of Catering Dept. Medical Dept. and Canteen staff w.e.f. 1.1.1996.”

(iii) The notification dated 21.1.2003 (Annexure-6), with

respect to pay-scale of Primary School Teachers in Railway Schools with monetary benefits w.e.f. 1.1.1996. The relevant clause is reproduced hereinbelow for the facility of quick reference:

INDEX NO. 1057- The senior and selection Grade Scales of Primary School Teachers in Railway Schools be revised w.e.f. 01.01.1996. 5. It is thus evident that of the four categories of employees of the Indian Railways, namely, Artisan Staff, Master Cook in Catering, Medical and Canteen Departments, and Primary School Teachers, have been given uniform treatment by identifying their appropriate pay-scales, and granting them monetary benefits w.e.f. 1.1.1996, the date on which the recommendations of the Vth Pay Commission were enforced. On the other hand, the employees of Accounts Establishment have been given a differential treatment. They have not been given monetary benefits w.e.f. 1.1.1996, but have instead been given notional benefits w.e.f. 1.1.1996, as a result of which they have been deprived of the differential amount of salary for the period 1.1.1996 to 19.2.2003. This calls for serious consideration.

6. The only logic advanced by the respondent authorities before the Tribunal was that these three categories of employees had threatened to proceed on strike, leading to mutual negotiations, and bipartite settlements. The Tribunal has, therefore, concluded that there was a sound basis to treat the

three categories of employees differently. In the absence of such agreement governing the employees of the Accounts Establishment, the Tribunal has concluded, it cannot be said to be a case of discriminatory treatment. 7. We have given our thoughtful consideration to the matter, and entirely disagree with the approach of the learned Tribunal. Threat of strike, and the consequent agreement, cannot be a valid basis for such a discriminatory treatment. We consider it to be a most unsound basis which can never be said to provide reasonable differentia with the object sought to be achieved. No logic has been advanced that the category of employees of Accounts Establishment have to be differently treated, say, for example, nature of duties and functions, in absence of which we have no hesitation in holding that this category of employees has been subjected to hostile discrimination. It was open to the respondents to give notional benefit to the employees of the Accounts Establishment, provided the same principle were applicable to all categories of employees, in the absence of which it falls foul of Articles 14 and 16 of the Constitution of India.

8. In the result, we set aside the order dated 30.6.2005, passed in O.A. no. 925 of 2003, and the orders dated 7.3.2009 and 16.6.2004 (Annexures- 3 and 9), stand modified. We take this writ petition to be in a representative category for all employees of the Accounts Establishment of the Indian Railways. all of whom shall get the benefits of appropriate pay-scales w.e.f.

1.1.1996, with payment of arrears of salary, but without the obligation of payment of interest. It goes without saying that the post-retirement benefits of such employees, who have already superannuated, shall be revised, apart from payment of arrears of salary. There shall be no order as to costs.

STRENGTHEN DEMOCRATIC FUNCTIONING


This is the time for stock taking for each of the affiliates – ie the time for elections and annual general body meetings.

In the Annual General Body meetings and also during the election time, the issues of the membership and the role of the leadership would definitely come for discussion, appraisal and approval.

It is also the time to subject important policy approaches for discussion and for decision. The leadership has to take the lead as well as bold steps to innovate and cause lively debates that would strengthen the unity, attract more members and activate the sleeping members to activists and elevate/throw up activists as leaders.

Any leadership would be assessed on the basis of these bold initiatives. A real leader is one throws challenges - and also accept challenges - and overcome it successfully through honest means.

The 45th Conference held at Jaipur has given a road map for strengthening the democratic functioning of the Associations at all levels.

Every unit should do their best to implement those decisions. In the AGM itself a road map for section activists system be finalised and acted upon without fail.

During unit visits of HQr leaders - many times - it has come to notice that circulars are not even read or discussed in the Executive Committee, as a result the ordinary members are totally unaware of the issues that we are focusing, pursuing and the results there-of. This is coming has a big hurdle at the time of mobilisation for agitations.

Instances of not holding a meeting of even Executive Committee during visits are confronted by the Secretary General himself, in some units. This could be an easy way of avoiding embarrassment to the Unit leadership in the presence of Secretary General, but it badly corrodes the organisational machinery.

This deficiency could be addressed through developing a section activists system, its regular meeting, discussion of each circular and Auditlekha Samanvay in the meeting of activists. This system of activists would also help the units to take up the local issues more effectively and also mobilise the membership when required.

System of Section activists also helps the organisation to carry the messages to the last member, whether it is of routine matter, attitude of the administration to the Gr B, C and D work force, privatisation and outsourcing of functions and its ill effects, Govt policies and our approach to it etc.

The issue of revising the rate of subscription upwardly from time to time would also be quite easy if such a systematic functioning is developed.

In the nutshell, system of (section) activists would raise the level of understanding of every member on issues and they would definitely value the organisation that is wedded to democratic functioning.

Equally important is enlisting the involvement of women employees in the organisational functioning and decision making.

There are many units where not even a single woman is elected to the Executive Committee. In many units it is name sake – one or two – with no significant role assigned to them.

In the 45th Conference at Jaipur, only 8 Units had women representation, including host unit.

Conscious and sustained efforts only can bring about a qualitative change in this regard.

The 45th Conference revised the HQr quota to Rs 8 per member per month – i.e. Rs 96 per member per year to be effective from 1st October 2010.

Units are requested to amend their constitution so as to revise the rate of subscription suitably (preferably Rs 50 per member per month).

INTERNATIONAL WOMENS DAY CELEBRATED

                       There has been good response to report on the International Womens day celebrations from many units. I had the privilege to attend the meetings organized by Chennai units on two days, that of Accounts and Audit. The meetings were memorable as there was good participation and the tireless and enthusiastic efforts of the women comrades in Chennai are notable. Let the International Womens day celebrations in its 100th year become a stepping stone to a bright future for the Women’s Committee of the All India Audit and Accounts Association, as we expect continued participation and co-operation in all the activities of the Association.

                      International Women's Day was created to inspire women throughout the world to work towards equality. In a country like ours where society is marred by heinous crimes against women, including rape, dowry deaths, female infanticide etc, the international women’s day holds special significance. With growing literacy and financial independence women feel more empowered today to assert their right to a life of dignity and self worth.

                 The International Women's Day celebrated on 8th March is a universal day for all women around the world. It endow them with a sense of honour, dignity and self respect for being the person that they are. This day marks a celebration of the economic, social, cultural and political achievements made by women over the years. However much more still needs to be addressed to make women equal citizens both in the public and private domain. The International Women’s Day thus serves as a reminder of how much we have achieved and how much more still needs to be done.

               Today no solutions - to the threatening social, economic and other problems faced by women - can be found without the full participation and the full empowerment of women. The reason is indeed a woman’s innate ability to care, love and sacrifice for the other. She plays an all-enveloping character of a mother, daughter, wife and sister as a friend, nurturer, guide and partner. Emotional and vulnerable, women displays a wonderful range of emotions from being patient to being extremely courageous in times of crisis.

             Contribute your might to strengthen our women’s Committee, thereby strengthening the All India Audit and Accounts Association. Participate actively by organising conventions, meetings, seminars, staging of gender sensitive plays in our department or jointly with other sister organizations to celebrate this centenary year of International Womens Day.
All activities may also please be reported to the All India Association promptly.

CONGRATULATIONS
At the very outset, the Apex Joint Action Committee congratulates all those constituents and their members who made the Mass Casual Leave on 8th April 2010 a stupendous success.

The programme was endorsed and effectively implemented by All India Audit and Accounts Association, National Federation of Civil Accounts Associations (All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category –II), All India Postal Accounts Employees Association and All India Audit and Accounts Officer Association.

As per the reports received through the constituents of apex JAC, Accounts and Audit Employees and officers from the stations like Kohima, Shillong, Guwahati, Kolkata, Bhubaneswar, Puri, Hyderabad, Tamilnadu state as whole, Bangalore, Trivandrum, Cochin, Calicut, Mumbai, Nagpur, Pune, Gwalior, Bhopal, Lucknow, Ahmedabad, Aurangabad and Delhi participated in the Mass Casual Leave on 8th April. The average station wise participation was more than 70% in almost all stations and states except in Delhi. In some of states and stations, cent percent members participated in the programme.

Through their participations the rank and file membership of Accounts and Audit Employees and Officers Organizations have established that - they are united under the banner of apex JAC and determined to fight against the discriminations done with them by the Government of India. By this successful united action, the Accounts and Audit Officers and Employees Organizations have also washed off the illusion from the minds of the present Government that, implementation of 6 CPC recommendations have made the Central Government employees totally satisfied and the Central Government Employees movement has been demolished.

We once again heartily congratulate all who made the mass casual leave on 8th April 2010 a grand success.
NEXT COURSE OF ACTION

The available leaders of apex JAC has reviewed the situation developed after the success of the mass casual leave programme. Apex JAC has decided that, firstly it shall examine the situation further after receipt of detailed report from all local constituents of JAC.

TASK AHEAD

It has been brought to the knowledge of apex JAC that, certain section of local administrations of different departments have been attempting to harass and penalise the persons participated in the programme, especially in IA&AD. It is reported that some other departmental authorities are also following the suit. From the day one of the birth of trade union movement, workers suffered atrocities of the powers that be. We should not loose heart for such things and should fight unitedly to foil the attempt for inflicting damages on us.

Some of the authorities have been learnt to be issued ‘show cause notice’ and asked to explain why disciplinary action should not be taken against him or her under FR 17 (A)/(I) and CCS conduct Rules 1964. It doesn’t make any difference whether you call it a memo or show cause notice – it is one and the same. But the phrase ‘show cause’ is used deliberately in an attempt to terrorize the employees.

Another set of administration have been attempting to deduct salary of the participants in the mass casual leave without giving the opportunity of giving the explanation by the individual-. All such attempts should be contested and no unilateral action should be allowed to be taken.

We are furnishing a sample reply to the memo/show cause notice for the guidance of the constituents. This reply has specifically been issued by the All India Audit and Accounts Association for its organization. This reply may be used by others if they face similar action. However, it is suggested that Unit/Branch/ individual should not take any action without consulting their respective Central Headquarters and Apex JAC headquarter,

Sir,

Respectfully we invite your kind attention to the award given by the Board of Arbitration on 24/08/2004 in regard to Pay Scale of Senior Auditors/Senior Accountants & Accounts Assistants of Railways which is as under-

“The Government is directed to upgrade Pay Scale same as to the Assistants of Central Secretariat services of Rs: 1640-2900 (Rupees 5500-9000 with effect from 01/01/96) to all Senior Auditors/Senior Accountants & Accounts Assistants of Railways with effect from 01/01/86 notionally and actual payment from 12/11/01 the date of reference of arbitration to the Board”

As per the instructions given by the Committee of Secretaries, the above award should have been implemented or referred to the Parliament for modification/rejection within a period of six months ending on 24/02/05. However, it has not so far been implemented.

The matter was discussed in the Committee of National Council J. C. M. The official side contended that more than Rs.1200 Crores would have to be paid by way of arrears if the award was implemented actually from 12/11/01 which the Government cannot afford. The staffside then suggested that actual payment may be from 19.02.03, the date from which Government have already ordered to upgrade the pay scale to Rs. 5500-9000 i. e. notionally w.e.f 01/01/96 actually from the above date. The official side stated that even then the amount of arrear to be paid would be Rs. 675 crores which is not feasible.

The staff representatives have thereafter, given in writing to forego all arrears and requested that the award may be implemented for the entire period from 01/01/1986 to 31/12/2005 notionally & actually from 01/01/06. Since by accepting the recommendations of VICPC, Government have already upgraded the pay scale of these employees to pre-revised pay scale of Rs 6500-10500 Pay Band PB-2 with grade Pay of Rs 4200 i.e. on par with that of Assistants of Central Secretariat, there would be no extra liability for the Government by way of arrears.

The matter is however, kept pending for last 3 years in the Department of Expenditure.

We, therefore request you to intervene and direct the Department of Expenditure to implement the award notionally for the entire period of 01/01/86 to 31/12/05 as it has been implemented with effect from 01/01/06.

The entire fraternity of employees of IA & AD and Organized Accounts Establishments will be grateful to you for this intervention and settlement of long pending demand.

     Based on the dismissal of Writ Petition of BPEF Union by the Hon'ble High Court of Madras, the Directorate which earlier cancelled the trade union facilities of some Unions including the P3 NFPE has issued fresh orders for restoration of the entire trade union facilities.

I am directed to refer to the Department's letters of even number dated 01.04.2010 and dated 19.04.2010 on the above mentioned subject. Honourable High Court of Judicature at Madras, has passed an order dated 26.04.2010 in the Writ Petition No.5848 of 2010 vacating the interim injunction order and directing the Respondents to expedite the process of verification under Rule 7 ( of the CCS (RSA) Rules, 1993) and announce the results expeditiously preferably within three months from the date of receipt of copy of this order.


2. Consequent upon directions of the Court, the trade union facilities , which were withdrawn from Respondents 5 to 7 of the Petition, stand restored.


3. As per schedule of verification indicated in the Department's letter No.13/10//2010-SR dated 18.02.2010 ibid, the stage of submission of ' 'Letters of Authorization' has been completed on 26.04.2010. In order to comply with the directions of the Court, it is requested to stick to the prescribed time schedule to complete the verification process and submit the consolidated statement in Pro-forma IV to the undersigned within the stipulated date i.e., 25.06.2010 positively.

DOPT ISSUED THE OFFICIAL MINUTES OF THE MEETING OF THE NATIONAL ANOMALY COMMITTEE HELD ON 27th MARCH 2010

     As per the Minutes the Chairman of the National Anomaly Committee assured that all new schemes will be introduced only after consultations with the Staff Side. Will the spirit of this statement will be kept in mind by the Postal Authorities is highly doubtful.

     The Chiarman assured constitution of a separate Joint Committee to look into the anomalies of MACP and the same is already constituted as we have intimated in our earlier blog.

      Chairman assured that the question of revision of FMA [Fixed Medical Allowance] is under the consideration of the Department of Pension and Pensioners' Welfare but he will take up with the Cabinet Secretary for early decision on this matter.

     Grant of 1800 Grade Pay to Temporary Status Casual Labourers is under the consideration of the DOPT.

      Date of increment on 1st July will not be postponed if an official do not have 6 months regular service from 1st January and 1st July every year; If the official has put in minimum 6 months regular service in a year his increment would be drawn on 1st July automatically - Orders to this effect would be issued soon.

     On important issues like grant of increment on 1.1.2006 to all officials whose increment date is between February and June, the Minutes says that this issue would be deeply considered for analysing any further anomalies and appropriate orders would be issued before the next meeting or if necessary further discussions would be held with the staff side by the Department of Expenditure.

      Next Meeting of National Anomaly Committee will be held in last week of June 2010.

JOINT COMMITTEE TO EXAMINE ANOMALIES IN MACP SCHEME CONSTITUTED BY DOPT

     As per the discussions held in the National Anomaly Committee meeting on 27.03.2010, a Joint Committee consisting of Officers from Official Side and Leaders from Staff Side has been consitituted. This Committee will go into all anomalies forwarded by the Secretary Staff Side National Council JCM and submit its report to the Chairman of National Anomaly Committee.

MODEL RECRUITMENT RULES FOR MULTI-SKILLED EMPLOYEES ISSUED BY DOPT

MODEL RECRUITMENT RULES FOR MULTI-SKILLED EMPLOYEES ORDERED BY DOPT


     We have been demanding early finalization of Recruitment Rules to enable recruitment of Multi-Skilled Employees in all Deprtments - Now the Model Recruitment Rules is ordered by DOPT and all Departments are asked to finalize the same for each and every Departments.
    The upgraded Group 'D' posts inTO Group 'C' will hereafterwords designated as " MULTI TASKING STAFF" - This new designation is more appropriate than Multi-Skilled Employees because the latter indirectly means all other categories of staff or not multi-skilled as like these upgraded Group 'C' posts. The misnomer 'Multi-Skilled Employees' has been corrected by designating as "MULTI TASKING STAFF".

     It has been clarified by the DOPT Order that the purpose of Multi Tasking Staff means that one employee performing jobs hitherto perfomed by several Group 'D' Employees.

     The Minimum Educational Qualifiction required is fixed as 'Matricultion' or 'ITI' [whereever technical qualification is required].
     The Model nature of Duties to be performed by the Multi Tasking Staff has been noted in t annexure - II of the above Model Recruitment Rules which are self explanatory to show that the earlier orders issued by Department of Posts entrusting the duties of DATA ENTRY WORK performed by Postal Assistants / Sorting Assistants was wrong. NFPE and the Staff Side had also demanded higher scale of pay to Multi-Skilled Employees or Postmen staff if they have to be extracted with Data Entry Work. Now the recent orders of DOPT makes the position very clear that the Multi Tasking Staff are to perform duties other than Data Entry Operations.
