Resolution to be sent to Authorities after holding first day of demonstration on 09.12.2019



RESOLUTION

            The General Body Meeting of this Association held on 09.12.2019 unanimously resolves to express its deep concern and strong protest over the reported move of the Department of Posts to decentralize the Postal Accounts.
            In this connection it is to bring to your kind notice that in the year 1987 it was experimented by placing the Postal Accounts personnel at H.O. level. That experiment was withdrawn later as the same was not successful. The Postal Board on many occasions has assured that the Postal Accounts will not be decentralized. With the advent of modern information technology in the Department of Posts, the need for any such physical deployment of Accounts personnel is obliterated. The Accounting work  of the Department can very well be managed and taken care of the by the employees and officers at the office of DAPs/GMs (F) under the guidance of PA Wing. This would help maintain effective monitoring as well as co-ordination of Accounting and Auditing activities under the supervision of Account and Finance officers. It is also not out of place to submit that the decision to decentralize the Postal Accounts has been taken at the back of the Staff Side. The Staff Side has insisted several times to spell out the role of the Postal Accounts in the CSI environment. But, the Staff Side has never been taken into confidence. Now, suddenly it is learnt that the Department is seriously considering the proposal to decentralize the Postal Accounts by deploying the Checkers in the Head Post Offices / Divisional Offices.
This General Body strongly objects to this unilateral & arbitrary action and earnestly appeals to the Secretary (Posts) to kindly issue necessary favourable orders to stop any proposed move to decentralize the Postal Accounts as it is neither in the interest of the Department nor is it beneficial or acceptable to the officials of Postal Accounts Offices. It is also earnestly urged upon the Secretary (Posts) to cause action for dialogue with Staff side with blue print of the role of Postal Accounts in the CSI environment so as to strengthen the Accounting functions and fiscal control in conformity with the Constitutional provision of probity and transparency in Public Expenditure.

Agenda for periodical meeting with Sr. DDG (PAF)

Sir,
In compliance of your letter dated 21.11.2019, I am submitting herewith the Agenda for the ensuing Periodical meeting schedule to be held on 17.12.2019. General Secretary (S.B. Yadav, PAO Lucknow), President (S. Santosh Kumar, PAO Chennai) and Finance Secretary (K.S. Rana, PAO Sundernagar) will attend the said meeting. It is requested to cause orders for necessary relief arrangements to facilitate them to attend the said meeting.
 Old Items:
  1.  Recruitment in the Departmental Canteens: This item was discussed in the earlier meeting and agreed upon. Unfortunately the PAOs are still reluctant to fill up the vacancies. Some PAOs are citing the absence of recruitment rules for not filling up the posts. DOP&T model RRs may be adopted and till such time existing RRs should be followed. There is an apprehension that due to inaction of PAOs, many vacancies may be lost. I request you to kindly intervene and cause filling up all vacancies.
  2. Consideration of applications under Rule 38 transfers by Staff of PAOs and adhering to the Guidelines stipulated under Rule 38.
  3. Filling of vacant post in PAOs Shillong, Guwahati and Thiruvananthapuram through local recruitment as a onetime measure.
  4. Removing the Residency condition in respect of graduate MTS staff to appear for the LDC exam: It was agreed in the earlier meeting to issue orders removing the residency condition in respect of graduate MTS staff to appear for the LDC exam. But the relaxation was extended to the Limited Departmental Competitive Examination only and not to the regular Departmental Examination. I request you too kindly to extend the same relaxation to the regular Departmental Examination.
  5. Merger of promotion quota of Sorters for promotion to the cadre of LDC: There are no eligible Sorters for promotion to LDC cadre. The result is that the entire quota of Sorters remained unutilized. Though the PA Wing is allowing the conversion of vacancies from one segment to another, many field units are not coming forward in time with such proposals. Hence, it is requested to merge this quota of promotion.
  6. Anomaly in seniority of LDCs promoted under SCF quota from Sorter and Gr.D cadres.
  7. Removal of anomaly in 7 CPC Pay fixation: If the pay is fixed as per the Matrix Table in respect of officials belonging to two different grade pay i.e. one is in higher grade pay and the other is in lower grade and both having same basic pay – the pay of official in higher grade is fixed at lower stage and the pay of official in lower grade is fixed at higher stage which is quite unnatural and unjustified. The above table is depicting the pay fixation as per the Pay Matrix i.e. in Levels 7, 8 & 9. It is seen that the official in higher grade-pay i.e. in GP 5400 with higher Basic Pay is being fixed at a lower stage when compared to the pay of the official who is in lower grade with GP of Rs.4800- & Rs.4600- and with lesser Basic Pay. Many such instances have come to the notice of this Association. This has to be rectified by allowing next higher stage to the officials who are in higher grade.

      8.      Finalisation of Cadre Restructure in Postal Accounts.
9.      Modifications in RRs of AAO: - This Association has been persistently pleading for the protection of the interests of PAO staff in the RRs of AAOs. However the Dept has not considered any of our suggestions. The AAO examination has been conducted in a hurried manner. It is once again requested to consider the suggestions put forth by this Association and arrange to incorporate appropriate modification in the RRs of AAOs.
10. Problems relating to PAOs in the CSI environment: - Due to lack of SOP or any uniform guidelines, the work of PAOs in CSI rolled out Circles has become haphazard. Different procedures are being carried out in different Circles by adopting different methodology. The Codal provisions of PAM (Postal Accounts Manual) have been thrown to the winds. The figures being submitted to the CGA through the E-Lekha (COMPACT) & newly introduce PFMS does not reflect the actual fiscal position of the Postal Dept. Immediate corrective measures are required to be taken.
New Items:

1.      Drop the move of Decentralization of PAO in any form, strengthen the role of PAO in CSI environment and roll out all the modules related with PAO. 

2.      Stop reopening and recovery of Stepped up pay granted in compliance of Judgement in OA No 2124/2011 by PAOs/GMs (F) of Bhopal, Bengaluru, Chennai and Hyderabad.

3.      Grant officiating promotion in AAO Cadre on vacant post from senior most Sr. Accountant of PAOs, till the modifications in RR of AAO Cadre, as suggested/demanded by the Association is finalized.

AIPAEA CIRCULAR 16

The Central Working Committee meeting of AIPAEA was held at Patna from 17.11.2019 to 19.11.2019. Reception committee had organized the CWC meeting in a very grand manner, within a short notice. A Galaxy of leaders attended the CWC meeting Com. Giriraj Singh, President, NFPE & GS of R-3, Com. C. Singh, G S, NFTE, Com. C. D. Singh, President COC Bihar, Com. Amresh Thakur, Ex. GS, AIPAEA, Com. T. Satyanarayana, Ex. GS, AIPAEA, Com. S. R. Mahato, Ex. Circle Secretary & CHQ office bearer, Com. U. K. Tiwari, Convener, COC NFPE, Bihar and all Circle Secretaries of NFPE, Bihar Circle attended the CWC. 17 units attended the CWC meeting.

          The meeting was started by flag hoisting.  Com. Amersh Thakur, Ex. GS, AIPAEA, hoisted National Flag, NFPE Flag was hoisted by Com. U. K. Tiwari, Convener, COC NFPE, Bihar, and Com. S. Santosh Kumar, President, AIPAEA hoisted the AIPAEA Flag. Offering of floral tributes to Martyrs followed the flag hoisting. Reception Committee felicitated all the leaders/guests by presenting mementos and garlands. Com. Umesh Prasad Singh delivered the welcome address.

Com. C. Singh, G S, NFTE inaugurated the inaugural cum open session of the CWC meeting. In his address Com. C. Singh elaborately explained the anti labour policies being adopted by this Government and about the mounting attacks on the working class. He explained the state of affairs going on in BSNL and MTNL. He appeals to the house to make the one day Strike on 08.01.2020 a grand success. He greeted the CWC a grand success and formally inaugurated the inaugural cum open session.
Com. C D Singh, President, COC, Bihar, in his speech also stressed for greater unity amongst the working class and appeal to make one day Strike a grand success. Com. U. K. Tiwari, Convener, COC NFPE, Bihar greeted the CWC a grand success and spoke in length on the adverse policies of the Government and the mounting attacks on the working class. He assured for all cooperation to the Bihar unit of AIPAEA from the NFPE co-ordination committee and appeal to get prepared for the one day National Strike. Com. S R Mahato, Ex. Circle Secretary of AIPAEA, all the Circle Secretaries of affiliates of NFPE also spoke in the inaugural cum open session.
Com. Amresh Thakur, Ex. GS, AIPAEA while delivering his speech recollected that this is the first CWC held in Patna, though AIC has been hoisted twice in Patna. He narrated how in adverse conditions and paucity of funds the Association was functioned in the initial years of its formation. In those days, almost all the work of correspondence was hand written or photocopies were used. Association has always worked for protecting the rights of its member. He also criticized the anti-Labour and anti-employees taken the Government and an introduction of the Labour code bill. He also appealed to the house to gear up for the one day token Strike of 8th January 2020 and make it a grand success.
Com. T. Satyanarayana, Ex. GS, AIPAEA, spoke in the post lunch session and elaborately explained the sacrifices made by our senior leaders like Com. Jatrana, Com. Dhaktod, Com. Amresh Thakur, Com. Rajnayagam and of course the guidance of Com. Vyasji, because of which we are in a better position. He said that there is no shortcut method to achieve our goals and continuous struggle followed by negotiations with the authorities, yields results. He suggested to short list the issues and prepared the charter of demands and go for agitational programme. He also appeal to the house that it’s not only financial demands to be pursued, but now its question of our survival and we should demand for more and more work for PAOs and prove our mettle to protect our staff strength and the PAOs.
In the post lunch delegate session, one minute silence was observed to pay homage to martyrs. Minutes of the last CWC meeting were placed by Com. Narshimhamurthy and confirmed by the house. After composition of the house General Secretary placed his report in the house for discussion and consideration of the house.

In the unit reporting all the Circle Secretaries/ Delegates reflected the issues faced in their unit, their membership, remittance of quota, participation in agitational programmes. Almost the problems faced by the units were common in nature, all the units were facing acute shortage of staff in all cadres, inadequate provision of infra-structure, lack of provision of proper training, threat of decentralization of PAO after implementation of CSI, arbitrary rejection of Associations demands in the final RR of AAO, investigation in the irregularities made in recently held AAO examination, Cadre restructure of PAO, issue of NPS, holding of confirmatory exam for JA twice in a year, building issues of PAO, Ahmadabad, Jalandhar and Trivandrum, recovery of stepped up pay in OA No. 2124/2011 in PAO, Hyderabad, Bangalore, Bhopal and Chennai, misuse of FR 56(J), Court cases filed by AIPAEA, Problems arising out of implementation of CSI, formation of New PAOs at Dehradun and Vijayawada and non forwarding of applications of deputation or under Rule 38 transfer cases almost by every Circle.

Delegates from Ambala, Bangalore, Bhopal, Chennai, Guwahati, Hyderabad, Jaipur, Kolkata, Lucknow, Nagpur, Ranchi, Patna, Raipur, Cuttack, Sunder Nagar, Shillong and Trivandrum placed their views in the discussion.
In the evening, there was two hours cultural musical programme. 

On second day, delegate session continued till the lunch hours. The house honored B. Mukherjee wife of Late Com. Deepak Kumar Mukherjee, shawl and bookey was presented to her by Com. Santosh Kumar, President, AIPAEA. House also honored President of Bihar Unit Com. Umesh Prasad Singh and Com. Hira Lal Bhakta, Accounts Officer and former President of Bihar unit, who are going to retire in the month of January 2020.     
While summing up the discussion, General Secretary gave replies to the queries of the units and placed before the house, the latest updates on various issues faced by the units. He categorically said that the decentralization of PAO in any form is not acceptable to AIPAEA, he also said that AIPAEA has made its stand clear before Sr. DDG (PAF) and other officers that modifications suggested by Association should be incorporated in the RR of AAO cadre by amending process. He also told that on CSI, AIPAEA has already communicated its stand to the Directorate and would give feedback on the issues/problems faced by officials of PAOs in implementation of CSI. He also assured house that all the issues faced by the units would be taken up with the authorities with renewed vigour. He appealed the house to be cautious on the issues and assured that Association will protect interest of its member at any cost. He also informed that the authorities of PA Wing have positively assured that in near future there will be no initiation on the decentralization issue and are agreed to modify the provision of RR of AAO after taking Member (Finance) into confidence.
The General Secretary placed before the house a three Phased agitational programme on five main sectional demands, which was approved by the house.
The Charter of Demands for which the agitational programmes will be conducted are as under:-
1.   Drop the move of Decentralization of PAO in any form, strengthen the role of PAO in CSI environment and roll out all the modules related with PAO. 
2.   Modifications in the RR of AAO Cadre, incorporating the suggestion given by Association, till then grant officiating promotion to Sr. Accountants on vacant posts of AAO Cadre.
3.   Time bound investigation by an independent agency in the irregularities of various nature in LDCE held in July 2018 of AAO.
4.   Finalization of Cadre Re-structure of PAOs.
5.   Stop reopening and recovery of Stepped up pay granted in compliance of judgement in OA No 2124/2011 by PAOs/GMs (F) of Bhopal, Bengaluru, Chennai and Hyderabad.

          The phased programmes of agitation would be as under:-
(1) Ist Phase: Holding of three days consecutive lunch hour demonstration, passing of resolutions and sending it to Authorities from 9.12.2019 to 11.12.2019 in PAOs.
(2) IInd Phase: Post Card Campaign from 13.01.2020 to 20.01.2020.
(3) IIIrd Phase: Day long Dharna on 13.02.2020 in PAOs.

A committee was constituted to study the pros and cons of the modules rolled out in CSI and about PFMS, to form the opinion of the Association, Com. R. B. Suresh as its convener, other members being 1. Com. Kumar Rajnish, 2. Com. P. Vijayan, 3. Com. M. Sudhakar and 4. Com. Mahboob Sharif. Com. R B Suresh, Volunteered to hold a workshop to study the impact of CSI at Chennai from 19.12.2019 to 21.12.2019 which was approved by the house. President and General Secretary would also attend the workshop.
 He appealed to the house to observe all the calls of future agitational programme given by CHQ, NFPE & Confederation. General Secretary strongly appealed to the house to make the one day Nationwide Strike of 8th January 2020 a grand success. General Secretary congratulated the reception committee for successfully holding the CWC meeting. He also thanked President Com. S. Santosh Kumar, Com. T. Satyanarayana for their help, and cooperation by all delegate and visitors in making the CWC meeting successful. The house authorized the General Secretary to decide and prepare the resolution to be passed by the CWC.

General Secretary declared the next CWC meeting will held in April/May 2020 at New Delhi.

The CWC meeting was concluded by proposing vote of thanks, by Com. Kumar Rajnish, Working president (CHQ), Com. Vindhyachal Singh, Circle Secretary, Patna, Chairmen of Reception Committee also proposed vote of thanks to all the leaders & Administration for accepting their request and attending the CWC meeting.

2020 JANUARY 8th NATIONWIDE STRIKE
ORGANISE MASS DHARNA AND DEMONSTRATIONS AND RALLIES
AT ALL IMPORTANT CENTRES AND STATE/DISTRICT/
DIVISIONAL HEADQUARTERS ON 20
th DECEMBER, 2019.
*        Strike to be organised on 10 points Charter of demands of Confederation (attached herewith) and also the common demands of workers adopted in the National Convention of Workers.
*        First and most important demand to be emphasized is “SCRAP NPS AND RESTORE OPS”.
*        Each affiliated organisation should independently chalkout intensive campaign programmes to mobilise their entire membership to participate in the strike.  Campaign tour programmes of leaders of each affiliate should be chalked out immediately.  This is most important and urgent.
*        Campaign tour programmes of National Secretariat Members of Confederation will be published shortly.
*        Draft copy of the pamphlet to be distributed among all the Central Government employees will be published in the Confederation website shortly.  C-O-Cs and Affiliates at state/district level to bring out pamphlets in respective vernacular, with additions/modifications if necessary.
*        State C-O-Cs should publish Posters with Confederation Charter of demands.
*        Strike notice along with Charter of demands will be served on 12th December, 2019.
          Confederation Central Headquarters will serve strike notice to Cabinet Secretary.  All Affiliated organisations should serve strike notice to their respective Departmental heads.  Copy of the strike notice should be submitted to all lower level authorities also at State/District/Divisional level with mass demonstrations and gate meetings.
*        Affiliated organisations should send copy of the strike notice served by them to their Departmental heads, to all their lower units and also publish the same in their websites.
*        State/District C-O-Cs should plan their own campaign programmes and mobilisation meetings.
*        Confederation Central Headquarters has already written to the Secretary General of Confederation of Central Government Gazetted Officers Organisation (CCGGOO) requesting to participate in the 8th January 2020 strike.
*        Message of the strike and strike demands should reach each and every Central Govt. employee including Gramin Dak Sevaks and Casual, Part-time contingent, daily-rated and Contract Workers.
*        All Affiliates and C-C-Cs should ensure maximum participation of Central Govt. employees in all the campaign and mobilisation programmes of Joint Action Council of Central Trade Unions and Independent Federations also.
*        As in the past, Government may issue circulars, threatening the employees who participate in the strike.  Ignore all such circulars and join the strike with courage and determination.  Don’t believe in rumours.  All information related to the strike will be published in Confederation website www.confederationhq.blogspot.com
*        Mass dharna at all important centres and also at State/District/Divisional headquarters may be organised on 20th December 2019, with maximum participation of Central Govt. Employees.
*        Give maximum publicity through local media, social media and websites.  Send photos and reports by whatsapp or Email to Confederation Headquarters.
*        Central Government Pensioners Associations may be requested to particpate in all mobilisation programmes and also to organise solidarity programme on 8th January, 2020.
          Remember, all our existing benefits and rights are achieved through struggles and sacrifices only.  No strike action will go in vain.  No sacrifice will go in vain.  We will fight and we will win.
II.       National Conference of Confederation of Central Government Employees & Workers:
          As already informed to all in the Circular dated 01-08-2019, the next National Conference of Confederation of Central Government Employees & Workers will be held at NAGPUR (Maharashtra) on 07-02-2020 and 08-02-2020 (7th & 8th February 2020; Friday and Saturday).  Delegate fee per head is Rs.1,000/- (Rs. One thousand only).  In addition to delegates, visitors are also allowed to attend the Conference on payment of Rs.1,000/- (Rs. One thousand only) per head.
          All Affiliated organisations and C-O-Cs are requested to ensure maximum participation of delegates and visitors in the National Conference, including maximum Lady delegates and visitors.
          Please book the travel tickets of the delegates and visitors well in advance.  Last minute, confirmed tickets will not be available.

          C-O-C Mumbai, C-O-C Nagpur and nearby states C-O-Cs may ensure participation of more delegates/visitors/lady comrades.
          Formal notice of the National Conference will be issued shortly.
          Number of Delegates and Quota Remittance:
          Number of eligible delegates of each Affiliated organisation and C-O-C is decided based on the quota remitted.  The National Secretariat meeting of Confederation held at Hyderabad on 19th October 2019, has decided that the subscription/quota dues list of affiliates will be placed in the Comnfederation website by the Financial Secretary shortly and all will be once again asked to pay out the arrears by 20-12-2019.  On the basis of remittances received thereupon, voting rights will be compiled and exhibited in the website.

10 POINTS CHARTER OF DEMANDS OF CONFEDERATION
1.      Scrap New Contributory Pension scheme (NPS).   Restore Old defined benefit Pension Scheme (OPS) to all employees.  Guarantee 50% of the last pay drawn as Minimum Pension.
2.      Honour assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016.  Increase Minimum Pay and Fitment formula.  Withdraw the proposed move to modify the existing time-tested methodology for calculation of Minimum wage.  Grant HRA arrears from 01-01-2016.  Withdraw “Very Good” bench mark for MACP,  Grant promotional heirarchy and date of effect from 01-01-2006.  Grant Option-I parity recommended by 7th CPC to all Central Govt. Pensioners.  Settle all anomalies arising  out of 7th CPC implementation.
3.      Stop corporatisation/privatisation of Railways, Defence and Postal Departments.  Withdraw closure orders of Govt. of India Printing Presses.  Stop proposed move to close down Salt Department.  Stop closure of Govt. establishments and outsourcing.
4.      Fill up all six lakhs vacant posts in the Central Government Departments in a time bound manner.  Reintroduce Regional Recruitment for Group B & C posts.
5.      (a)     Regularisation of Gramin Dak Sevaks and grant of Civil servant status.  Implement remaining positive recommendations of Kamalesh Chandra Committee report.
          (b)     Regularise all casual and contract workers including those joined on or after 01-09-1993.
6.      Ensure equal pay for equal work for all.  Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.
7.      Implement 7th CPC Wage Revision and Pension revision of remaining Autonomous bodies.  Ensure payment of arrears without further delay.  Grant Bonus to Autonomous body employees pending from 2016-17 onwards.
8.      Remove 5% condition imposed on compassionate appointments.  Grant appointment in all eligible cases.
9.      Grant five time bound promotions to all Group B & C employees. Complete Cadre Review in all departments within a time-frame.
10.    (a)     Withdraw the anti-worker wage/labour codes and other anti-worker Labour reforms.  Stop attack on trade union rights.  Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.
          (b)     Withdraw the draconian FR 56 (j) and Rule 48 of CCS (Pension Rules 1972.
