DOPT ORDERS ON ACR GRADING FOR CONSIDERATION OF DPC


DOPT ORDERES ON ACRs WITH BELOW BENCHMARK GRADING CONSIDERED IN PAST DPCs



Dear Comrades,


DOPT has issued another clarificatory orders on the issue of ACRs with below benchmark grading considered in past DPCs closely on the foot steps of its recent orders on 13.04.2010 making it mandatory to supply the adverse entries in ACRs prior to 2008-09 to the officials for facilitating those officials to make representations if any for the consideration of the Reviewing Authority.


However,, the presnt clarificatory orders dated 27th April 2010 of the DOPT is to make the Officers guarded against granting such promotions if any from a retrospective date based on the upgradation of the grading by the competent authority based on the judgment of the Supreme Court in the Dev Dutt Vs Union of India case. The DOPT has cautioned all the Officers to take advantage of another judgment of the same Supreme Court in the Union of India Vs A.K.Goel & others case and the latest referals to a larger bench of the Supreme Court of India on the face of contradictory judgments of Supreme Court in the past.


This laterst clarificatory orders takes away the benefit of getting the benefit of promotion from a retrospective date even though the Reviewing Authority upgrade the benchmark on representation from the official agains the negative grading made in the ACRs. Therefore this is a negative order.

NEWS FLASH - BPEF UNION'S WRIT PETITION DISMISSED BY HON'BLE MADRAS HIGH COURT

HERE IS A NEWS FLASH - THE WRIT PETITION FILED BY BPEF UNION IN MADRAS HIGH COURT AGAINST THE TRADE UNION FACILITY OF P3 UNIONS OF NFPE & FNPO AND IRM&ASRM UNION STANDS DISMISSED TODAY

HAIL THIS LEGAL VICTORY


    As already intimated by our websites, the Writ Petition filed by the BPEF Union in the Hon'ble High Court of Madras came up for hearing today. The Interim injunction granted to the trade union facilities of P3 NFPE Union and FNPO Union was opposed by our Advocate. The Government Advocate also presented the case of the Government side. On hearing the arguments of our Advocate, the Honourable Judge dismissed the WRIT PETITION filed by the BPEF Union and ordered immedieate restoration of trade union facilities to P3 Unions of NFPE and FNPO and also the IRM&ASRM Union which was cancelled based on the Interim Injunction granted by the Hon'ble Madras High Court recently.

     In addition the Honourable Judge ordered that whole process of Re-verification has to be concluded within a period of three months - This means there is no stay to the ongoing process of Re-verification and the process will continue as usual.

     NFPE hails this legal victory as the 'victory of the Postal Employees' who have always stood for honest trade unionism and opposed all types of machinations to scuttle the recognition of historic Federation and its Affiliated Unions and Associations. This legal victory should be a lesson to all forces who feel happy to see the trade union facilities temporarily withdrawn by the Administration on the face of Interim Injunction. Such types of joy aimed against our movement will only be short-liven as in the present case.


     With this restoration of trade union facilitiy and the direction of the Honourable Court for completion of Re-verification process, NFPE calls upon all the Divisional and Branch Secretaries to complete the process of submission of Declaration Forms with 5 lists with their signature at the bottom of each page today itself - Remember today [26.04.2010] is the last day of submission to the Divisional Heads.

CONGRATULATIONS

     At the very outset, the Apex Joint Action Committee congratulates all those constituents and their members who made the Mass Casual Leave on 8th April 2010 a stupendous success.



     The programme was endorsed and effectively implemented by All India Audit and Accounts Association, National Federation of Civil Accounts Associations (All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category –II), All India Postal Accounts Employees Association and All India Audit and Accounts Officers Association.



    As per the reports received through the constituents of apex JAC, Accounts and Audit Employees and officers from the stations like Kohima, Shillong, Guwahati, Kolkata, Bhubaneswar, Puri, Hyderabad, Tamilnadu state as whole, Bangalore, Trivandrum, Cochin, Calicut, Mumbai, Nagpur, Pune, Gwalior, Bhopal, Lucknow, Ahmedabad, Aurangabad and Delhi participated in the Mass Casual Leave on 8th April. The average station wise participation was more than 70% in almost all stations and states except in Delhi. In some of states and stations, cent percent members participated in the programme.



     Through their participations the rank and file membership of Accounts and Audit Employees and Officers Organizations have established that - they are united under the banner of apex JAC and determined to fight against the discriminations done with them by the Government of India. By this successful united action, the Accounts and Audit Officers and Employees Organizations have also washed off the illusion from the minds of the present Government that, implementation of 6 CPC recommendations have made the Central Government employees totally satisfied and the Central Government Employees movement has been demolished.



     We once again heartily congratulate all who made the mass casual leave on 8th April 2010 a grand success.



NEXT COURSE OF ACTION

      The available leaders of apex JAC has reviewed the situation developed after the success of the mass casual leave programme. Apex JAC has decided that, firstly it shall examine the situation further after receipt of detailed report from all local constituents of JAC and thereafter decide the next step to be taken.





TASK AHEAD



     It has been brought to the knowledge of apex JAC that, certain section of local administrations of different departments have been attempting to harass and penalise the persons participated in the programme, especially in IA&AD. It is reported that some other departmental authorities are also following the suit. From the day one of the birth of trade union movement, workers suffered atrocities of the powers that be. We should not loose heart for such things and should fight unitedly to foil the attempt for inflicting damages on us.



     Some of the authorities have been learnt to be issued ‘show cause notice’ and asked to explain why disciplinary action should not be taken against him or her under FR 17 (A)/(I) and CCS conduct Rules 1964. It doesnot make any difference whether you call it a memo or show cause notice – it is one and the same. But the phrase ‘show cause’ is used deliberately in an attempt to terrorize the employees.



     Another set of administration have been attempting to deduct salary of the participants in the mass casual leave without giving the opportunity of giving the explanation by the individual-. All such attempts should be contested and no unilateral action should be allowed to be taken.



     We are furnishing a sample reply to the memo/show cause notice for the guidance of the constituents. This reply has specifically been issued by the All India Audit and Accounts Association for its organization. This reply may be used by others if they face similar action. However, it is suggested that Unit/Branch/ individual should not take any action without consulting their respective Central Headquarters and Apex JAC headquarter,

In this regard, I may submit that there is no provision in the Conduct Rules under which employees can not take Mass Casual Leave. To treat Mass Casual Leave as strike is an executive order which has no statutory validity.


To go on a casual leave in order to register a protest comes under exercise of Fundamental Right of freedom of expression and therefore treat it as a virtual strike is an infringement of the above fundamental right of freedom of expression. As a matter of fact authorities should take note of the discontent expressed by the employees by constitutional means of going on Casual Leave collectively and take positive measures to settle the grievances. Your proposal to proceed against me is not only an unconstitutional and illegal action but it betrays a total negative and confrontist attitude towards the action taken by the Staff Associations.


I therefore request you to refrain from any action that you have proposed in the show cause notice/memo. I further request that the casual leave applied may please be sanctioned.

IMPATIENCE OF BUREACRACY IN DEALING STAFF REPRESENTATIONS EXHIBITED BY GOVERNMENT ORDER

IMPATIENCE OF BUREACRACY IS GROWING


     The only opportunity available to Government staff to represent against any injustice perpetrated is through Representations to different Authorities in the Government Machinery - This basic right is also being curtailed now on the plea that such representations are bogging down the Official Machinery!!

     DOPT issued an order on CCS Conduct Rules 1974 on submission of representations by Government Servants on 19th April 2010 curtailing the rights of Government Employees to represent by restricting the Officers from considering any representation made beyond two times on the same issue - Even the second representation should be ignored if not new points are brought to the notice by the representing officials.

     This shows the impatience and growing intolerence of bureacracy towards dealing the representations from staff, which is a basic democratic right so far available to us.

  This stand of the Government will force large number of officials to approach for remedy in Central Administrative Tribunals and Higher forums of Judiciary in future.

ON NON-SETTLEMENT OF BURNING ISSUES

     The Central Head Quarter of All India Audit & Accounts Association and Apex JAC greet and congratulate every audit and accounts employee and officer for the magnificent show of dissent by joining the call for Mass Casual Leave.

     The Audit & Accounts employees and officers rose like one person to record its disapproval of non settlement of burning issues faced by them through negotiation with the Association by massively abstaining from work on 8th April 2010.

     Breaking from the past every body - from Gr D to SAO - joined the mass abstention demanding negotiated settlement of charter of demands and also standing upto the mandarins in the North Block who deny the status and pay scale to audit and accounts employees and officers at par with those in CSS.

     This massive protest also conveyed to the CAG’s administration that the draconian laws and perverted officers’ actions will be questioned and the victimisations of the Association leaders, be it in Kerala, Rajkot, Gwalior, Kolkata or elsewhere will not be tolerated.

      This time we saw a new method of administration bending backward and sanctioning leave liberally. That is what we want, sanction leave for all those who applied – whether Casual leave, Earned leave or medical leave. The offices through out India wore a deserted look today ie, 8th April 2010.

       The employees and officers abstained –either by applying CL on 8th April or by availing leave for more than one day (when we give call for one day work stoppage, the administration wants more days’ work stoppage!) in the following stations and offices.

Kohima, Nagaland – Near total in Accounts Category II and III
Shillong, Meghalaya – Near total in Accounts Cat II and III
Guwahati, Assam – Near total in Accounts Cat II and III
Kolkata, WB - Nobody was present in the offices of PAG (Audit), PDA (C), PAG (A&E)
Total in ERly Audit, P&T Audit, MAB II, Defence Audit, MAB II
Bhubaneswar, Orissa – Total in Accounts Cat II & III

THIS IS A LESSON, THIS IS A BEGINNING

      The administration wanted this Association to withdraw the Mass Casual Leave programme of 8th April 2010 but without any commitment on settlement of issues.

     It was told in clear terms to administration that withdrawal or deferment will be considered if the issues of victimisation is addressed to immediately and CAG make a personal intervention on the issues of implementation of arbitration award and pay scales while a road map is agreed to on negotiated settlement on other items in the charter of demands.

    The administration tried to create terror in certain pockets. Despite all these the employees and officers have stood firm.

Wishing all success to the Organized Accounts for a glorious struggle .

EMPOYEES & OFFICERS OF ORGANIZED ACCOUNTS OF GOVERNMENT OF INDIA DEPARTMENTS ON AGITATION.
Mass Casual Leave Programme will be launched on 8th April 2010.

     Postal Accounts Employees and Postal Accounts Officers are fully preparing themselves for the programme of Joint Action Committee of Accounts and Audit Employees and Officers Organizations.

     The Employees and Officers of Organized Accounts are on agitation on a Charter of Demands that includes demands like Pay Parity with the Central Secretariat on Notional basis w.e.f. 1.1.1996 with actual benefits from 1.1.2006; MACP on the basis of hierarchy of departmental promotions; Higher Pay Scales for LDC etc.

     NATIONAL FEDERATION OF POSTAL EMPLOYEES EXTENDS TOTAL SOLIDARITY WITH THE EMPLOYEES AND OFFICERS OF ORGANISED ACCOUNTS IN GENERAL AND THE POSTAL ACCOUINTS IN PARTICULAR AND CALLS UPON THE ENTIRETY OF POSTAL EMPLOYEES TO ORGANISE SOLIDARITY DEMONSTRATIONS IN FRONT OF POSTAL ACCOUNTS OFFICES IN GREAT NUMBER IN WORK SPOTS ESPECIALLY IN STATE CAPITALS AND CENTRES WHERE THE POSTAL ACCOUNTS OFFICES ARE WORKING ON 8.4.2010.

     NFPE is sending a FAX to the Hon'ble Finance Minister requesting him to intervene and settle the justified issues of Organized Accounts Employees & Officers. Postal Coordinating Committee leaders wherever they exist and Circle Secretaries of NFPE Unions in all places are requested to mobilize the Postal Employees in large number and show our solid support and solidarity to the cause of employees and officers of Organized Accounts. P3 CHQ also requests the Divisional and Branch Secretaries to take active part in mobilizing Postal Workers to the above solidarity demonstration and build a strong bond between the Postal Employees and Postal Accounts Employees
