Court: Keeping workers permanently temporary ill behoves government

Bench expresses displeasure at BRO's treatment of casual workers
Vartak Labour Union members have been working with it for 30-40 years.

New Delhi: The Supreme Court has deprecated the Union of India engaging casual workers and keeping them in temporary service for long without making them permanent employees, thereby denying the benefits due to them.
Expressing its displeasure and anguish at the manner in which the Border Roads Organisation treated its casual workers, a Bench of Justices D.K. Jain and H.L. Dattu said engaging casual workers for less than six months and giving them artificial breaks so that they would not become eligible for permanent status ill behoved the Union of India and its instrumentalities, “which are supposed to be model employers.”
Justice Jain, writing the judgment, quoted an earlier ruling said: “It is a fact that a large number of casual labourers have worked with Project Vartak for a number of years but their period of engagement at no stage is more than six months at a time. Their services are terminated before the completion of six months and they are recruited afresh and they do not get the status of permanent employee. As per the regulations, casual personnel are not eligible for any other privileges for continued employment under the government.”
In the instant case, the Union of India appealed against a Gauhati High Court judgment directing the government to regularise the services of members of Vartak Labour Union, some of whom had been working with the BRO for 30 years. Formulation of any scheme for regularisation being a matter of policy, it was not within the High Court's domain to direct regularisation of the services of temporary appointees, the Centre said.The Bench agreed with its contention and said the union's claim for regularisation of its members merely because they had been working for BRO for a considerable period could not be granted in the light of several decisions of this court. The Bench, quoting these judgments, said: “Casual employment terminates when the same is discontinued and merely because a temporary or casual worker has been engaged beyond the period of his employment, he would not be entitled to be absorbed in regular service or made permanent, if the original appointment was not in terms of the process envisaged by the relevant rules.”
However, in the facts and circumstances of the case, where the union members had been employed in terms of the regulations and had been consistently engaged for the last 30 to 40 years, of course with short breaks, “We feel the Union of India would consider enacting an appropriate regulation/scheme for absorption and regularisation of the services of casual workers engaged by the BRO for execution of its on-going projects,” the Bench said.

PROTEST DAY ON 23-03-2011 IMPLEMENTED IN A BIG WAY

Congratulations! The call given by the CHQ to send resolutions on 23-03-11 has been observed by all the units in a very big way. Such a show of strength in unison is the need of the hour. Keep it up. 
General Secretary has submitted the Charter to the DDG(PAF) on 23-03-2011 and it has been assured that a meeting will be held to discuss the issues. I hope the said meeting will be held without delay.
I call upon all the members to actively involve in the Post Card campaign from 28-03-2011 and ventilate their strong urge for the settlement of the demands.
Protest is the symptom of simmering  anger over the inaction or injustice or the inordinate delays. Let's hope the Authorities will take note of our protest and settle the demands to our satisfaction.

Postal JCA meeting is going to take place on 30-03-2011 to discuss the programme of action to counter the policy  offensives by the Department of Posts. Detailed programme will be communicated after the meeting.

The case of 4-advance increments is under reference to the Ministry of Finance. I hope it will be settled in our favour.

Apex JAC is going to meet at Hyderabad on 11-04-2011 to discuss all the issues related to the Audit and Accounts employees.

"JA and SA case" where we have filed fresh OA in the Hon'ble Pr.CAT, New Delhi, notices have been served to the Department. We are finalizing the fresh Miscellaneous Petition in the Stepping up case.

There is no need for the approval of CPMGs concerned for taking up the Recruitment in the PAOs. In this regard a letter has been sent to the Bangalore PAO from the PA wing.All units should note this and should exert pressure on the Circle Authorities (if necessary by holding demonstrations and passing resolutions) and get all the hurdles cleared for the recruitment.   

The present thinking on the rounds in respect of the Postal Accounts re-organization is 'Regionalization' earlier it was 'Divisionalization'. I don't know when this will also change. But let's not diminish our determination to oppose decentralization of PAO in any form.

General Secretary is visiting Jallandhar and Kapurthala on 29-03-2011.

CPI (M) FORCES DIVISION OVER BILL (PFRDA)

            A day after a heated discussion took place in Parliament on the WikiLeaks disclosures published in The Hindu, it was business as usual in the Lok Sabha on Thursday. Speaker Meira Kumar went through the process of 'Papers to be laid on the Table' and then got down to the legislative business, including the introduction of the Pension Fund Regulatory and Development Authority Bill, 2011.

            As soon as she called out Minister of State for Finance Namo Narain Meena, standing for Finance Minister Pranab Mukherjee, to introduce the Bill, CPI (M) leader Basudeb Acharia stood up, opposing the introduction of the Bill and demanding a division, taking the Treasury Benches by surprise.

            Only a handful of Ministers were present, including Parliamentary Affairs Minister Pawan Kumar Bansal, along with his deputy V. Narayanasamy. Caught unawares, the treasury benches too wore a rather thin look, enough for the government to sense trouble. Both the Ministers went up to National Democratic Alliance working chairman L.K. Advani and Leader of the Opposition Sushma Swaraj, and talked to them. It became clear that the main Opposition BJP would come to the government's rescue.

            Mr. Bansal cited Rule 72 on the government's legislative competence to introduce the Bill and sought to know the grounds on which Mr. Acharia was opposing it, but the CPI (M) leader refused to budge from his demand for division.

            The Speaker ordered division when Mr. Acharia further pressed for it. "We are opposing the introduction of the bill. I am asking for division instead of a voice vote," Mr. Acharia said.

            Of the 159 members present in the 543-member House, 115 voted for introduction of the bill and 43 opposed it, while one abstained. Prime Minister Manmohan Singh, Leader of the House Pranab Mukherjee, UPA chairperson Sonia Gandhi, several Ministers and Congress members were not present.

            Rashtriya Janata Dal leader Raghuvansh Prasad was heard saying that when the Speaker had already ordered division, it could not be rolled back.

            The bill provides for the establishment of an authority to promote old-age income security by creating, developing and regulating pension funds and to protect the interests of subscribers to pension fund schemes.
