Casual Labourers both full time and part time / contingent wage revision file has been returned by the MOF with the direction to send the same to DOPT - File is expected to go to DOPT shortly - Positive early orders not appear in sight - NFPE will discuss with the Postal JCA for Action Programme on this issue

NFPE Discussed the issue of Immediate Relief of all AAO Promotees and Pointed out the situation arising out of interpretation from some circles awaiting endorsement of second list released by DOT.

RE-GRADING OF ACR BY DPC - AN IMPORTANT ORDER BY DOPT
DOPT ordered that in cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the adverse remarks of Reporting I Reviewing / Accepting Authorities have been expunged or modified by the Competent Authority, the "overall grading" in the ACR be kept blank for appropriate re-grading by the DPCs.

OFFICE MEMORANDUM
Subject:- Effect on modification/expunction of adverse remarks in the ACRs and upgradationldown-gradation of the overall grading in the ACRs prior to the period 2008-2009.
The undersigned is directed to say that instructions were issued vide O.M. of even number dated 14th May, 2009 by which the complete APAR (previously known as ACR) including the overall grading and assessment of integrity shall be communicated to the concerned officer for representation if any, with effect from the reporting period 2008-09 which was to be initiated from 1.4.2008. Prior to that only adverse remarks in the ACR were required to be communicated for representation, if any. The then existing instructions further provided that the overall grading in the ACR should remain unchanged even after modification or expunction of the entire adverse remarks. It was left to the DPC to re-determine the overall grading if it considered that the expunction of such adverse remarks had so altered the quality of the ACR. The matter has been further considered and it has been decided that in those cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the adverse remarks of Reporting
I Reviewing / Accepting Authorities have been expunged or modified by the Competent Authority, the "overall grading" in the ACR be kept blank for appropriate re-grading by the DPCs. The existing grading shall be blocked in such cases. It has also been decided that where the authority has upgraded / downgraded the overall grading without giving sufficient reasons, the DPC shall treat such an exercise as non-est/ invalid. General terms, such as "I agree or disagree with the Reporting Officer /Reviewing Officer" used by the Reviewing I Accepting Authority shall not be construed as sufficient reason for upgrading / downgrading the overall grading given by the Reporting Authority / Reviewing Authority. The proposals for the DPC where ACRs upto the reporting period 2007-08 will be taken into account should specifically bring out these guidelines.
2. It is also made clear that past cases already decided will not be re-opened.

Dear Comrades

          All of you might be aware that how under the Fourth and Fifth Pay Commissions Accounts and Audit Employees and Officers were treated badly and only through sustained struggle by all the Audit and Accounts Staff that we were able to achieve parity with Central Secretariat from 19-02-2003 for Sr.Auditors / Sr.Accountants / Accounts Assistants and next higher Grade for other Cadres. How ever there was no improvement in the pay Scales of AOs and Sr.AOs. Now the Sixth CPC is no different and the discriminations still persist.
          The Apex JAC utilized the opportunity of presenting Oral evidence before the Sixth CPC and the delegation led by Com. S.K. Vyas was successful in forcefully presenting the justification for parity in Pay scales with Central Secretariat. All the Members of Pay commission were fully convinced of the fact that when ever the previous Pay Commissions extended parity , the same had been disturbed by the Government by granting higher scales outside the Pay Commission. Contrary to this personal acknowledgement, in its Report the Sixth CPC claimed that the Government never conceded Parity and gave only identical pay scales under different circumstances. The Report was accepted and implemented by the Government.
Now in the same old fashion, the Finance Ministry has granted Grade Pay of Rs.4600/- to the Assistants and Stenographers of Central Secretariat w.e.f 01-01-2006 outside the Pay Commission disturbing the parity in Pay Grades between the Central Secretariat cadres and the Organised Accounts and Audit Cadres and totally disregarding the recommendation of 6 CPC to grant absolute parity between similarly placed personal employed in field offices and in the Secretariat..
          Apart from this, ignoring the recommendations of VI CPC vide Chapter 3, Government has denied the legitimate Grade Pay of Rs.4200/- to Accountants/Auditors/Junior Accounts Assistants. By placing the LDCs/Accounts Clerks in Grade pay of Rs.1900/-, they have almost been equated with Group D Staff now rechristened as Group C with a Grade Pay of Rs.1800/-. The above ignominy has to be fought tooth &nail.
          The different authorities of Accounts and Audit Organizations are reluctant to consider the issue of Grant of higher Sale and Group-A status to AO/SAOs and recommend for Grant of parity between the Accounts/Audit Cadres and Central Secretariat Cadres.
          The implementation of MACP has added insult to the injury. The scheme has lost its purpose and has served as a tool to the Authorities to divide the staff by enabling the Juniors to get placed in  higher Grades leaving the Seniors to languish. In this regard, the JAC is demanding Stepping up of Pay for the Seniors and Grant of ACP as per departmental hierarchy.



             In the Apex JAC Meeting held on 8th December 2009 at Delhi, after thorough deliberations unanimously concluded that the Accounts and Audit Employees and officers are not having any other alternative but to resort to industrial action against the discrimination. The considered opinion of the Apex JAC is that the proposed industrial action should take place in the 1st half of March 2010.
          The Apex JAC further decided that to prepare the employees and officers for an industrial action, effective campaign programme should be taken up such as:
          1. Campaign Week from: - 4th to 8th January 2010 :- Campaign week shall be observed from 4th to 8th January 2009. During this week, membership shall be mobilized by organizing different programmes like floor meeting Gate meeting, Lunch lour meeting etc. (Campaign material shall be circulated by the apex JAC)
          2.  Demands Day on 21 – 01 – 2010 :- On this day all Units/Branches shall submit charter of demands in the from of memorandum to the local heads of the Department after a massive lunch hour demonstration.
           In order to adopt the resolutions passed in the Apex JAC Meeting, the local JAC met on 30th December 2009. It has been decided to give thrust to the activities of JAC and prepare for a sustained and united struggle by all the employees of Organised Audit and Accounting organizations in order to restore the lost pride, prestige and dignity of the Audit and Accounts Employees and Officers by getting the higher Grade Pay for all Grades as per the Charter of demands already placed.
          It has been decided to observe the Campaign Week from 5th to 12th of January as per the following time table.

5th & 6th  Jan’2010 - Distribution of Pamphlets
7th Jan’2010 – Campaign in AG’s Offices
8th Jan’2010 – Campaign in Postal Accounts & Audit Offices
11th Jan’2010 – Campaign in Railway Accounts and Audit Offices
12th Jan’2010 – Campaign in Civil Accounts Offices

Charter of demands :-
1.    Implement arbitration award by granting higher pay scale notionally w.e.f.1-1-1986 and effectively w.e.f 1-1-2006.
2.    Upgrade LDCs /Accounts Clerks by re-designating them as Acctts/Audit Assistants and following pay sales to different cadres-
                   Accounts/Audit Assistant                                 PB-1 with Grade Pay Rs.2400
         Accountant/Auditor/Jr. Accts Asst./Steno Gr.II PB-2 with GP             Rs.4200
         Sr. Accountant/Auditor/Accts.Asst./Steno Gr.I  PB-2 with Grade Pay Rs.4600
         SO/JAO/AAO/PS                                              PB-2 with Grade Pay Rs.4800
                                                                             PB-3  with Grade Pay Rs.5400
                                                                                   On completion of 4 years.

3.    Grant MACP on departmental hierarchy basis.
4.    Grant one increment and Grade pay of Rs.4800 from the day of passing JAO/SOG/App.III(Rlys) examination.
5.    Grant three increments on passing departmental confirmatory examination.(App.II for Rlys)
6.    Step up pay of Senior Promotees who exhausted ACP in the event of junior drawing more pay and getting ACP in compliance with apex court judgment.
7.    Ministry of Railways should treat Railways Accounts as a separate entity and grant recognition to the representative body of Accounts Employees of Railways i.e. All India Railway Accounts Staff Association without any delay. 
Comrades, it is time for us to come together without any cadre discrimination and put up a united fight till all the above demands are achieved.

Hon’ble Minister of Communications as well as Minister of State have cleared the crucial file regarding Merger of Accounts cadres of P & T, with clear cut instructions to all concerned Authority to comply with them in respect of the following three items:

1. All information sought by the Steering Group for Merger may be supplied by Officers of any rank in the Departments of Posts & Telecom

2. All promoted officials (465 waitlisted officials) may be relieved within Three Days time enabling them to assume charge and

3. Gazette Notification issued by the DOT to be implemented true to its letter and spirit.

Thus, the writing on the wall has become specific and categorical about Merger as well as Cadre Controlling Authority. Now, it has become our duty to give final touch to this hard won product of struggle by accepting the Provisional offer of promotion immediately and ready to undergo the proposed Training/Promotion.

It is, therefore, requested that all qualified officials may approach their concerned CCA, DOT and accept the offer of Promotion as per the Pro forma enclosed therein. This need not be confused with the question of Relieving order to be issued by DOP which will follow soon.
